EU Puts Damper on Netherlands Casino Monopoly
The Netherlands continues to stir up some heat in the online casino
gambling industry with two separate incidents this week, which could
affect future court policy and the stance of the Dutch government
regarding gambling monopolies. In both incidents, Dutch gaming and
legislative authorities were struck down for their support of a gambling
monopoly in the Netherlands.
The first of the two incidents directly involves the European Union,
and comes in the form of a warning from EU Commission VP, Gunter
Verheugen. The warning stated that the Dutch governments intention
to give a three year license to Holland Casino for exclusively operating
online casino games out of the Netherlands would be in violation of
anti-monopoly provisions as set forth by the EU. Exclusively
granting a single casino rights to offer online gaming would counter the
EU's policy of other union members having freedom to operate in other EU
countries.
In another case that does not shine favorably on the Dutch gaming
authorities, the Netherlands Administrative Court of Breda ruled the
Dutch Ministers of Justice and Economics failed to prove they have just
cause in setting up a gambling monopoly and keeping other casino
operators from doing business in their jurisdiction. Although
there was no word on whether the decision would be appealed, the
Ministers claimed they were accomplishing their goals set forth when
deciding to pursue a gambling monopoly.
