NIGC Seeks Clarification on Regulating Indian
Casinos
The National Indian Gaming Commission (NIGC)
may be no more if nothing is done to clarify its regulatory powers and
its affairs with the U.S. Congress and state laws. Senator John
McCain, who is the Senate Indian Affairs Committee chairman, stated that
either the Commission be put out of commission or for Congress to
delegate the appropriate executive powers to the Commission that it
would need to create uniform and fair gambling standards in all tribal
casinos. McCain is a senator for Arizona, and as such, has special
concerns for his constituents when they go into one of the several
Indian reservation casinos to gamble.
According to NIGC Chairman, Philip Hogen,
Congress is taking away the regulatory powers of the NIGC. He
cited a recent case in which Congress ruled that the NIGC could not
regulate slot machines, and casino table games at Colorado River Indian
Tribe Reservations in Arizona. This is what Senator McCain was
addressing when he made his comments that the existence of the NIGC
might as well be considered null and void.
Hogen went on to address that the
Commission is not seeking more authority in regulating its domain of
casinos, but that it simply wants the gambling regulation laws to be
spelled out more to insure a continuation of proper communication
between the Board and Federal agencies - standard checks and balances,
so to speak. For Congress to step in and say that the NIGC can
regulate only certain casinos undermines the Commission's authority and
begs one to consider why the NIGC is operating in the first place if
Congress is making all the calls.
